Real Estate

Haines & McNeill has a rapidly growing and diverse real estate practice including substantial and complex property acquisitions, sales and exchanges, commercial and industrial leasing, joint venture projects, mortgage financing, construction contracts and environmental matters. We serve corporations, partnerships and individuals. Whether our client is a first-time home buyer, a small business owner building an office building, or a national developer subdividing a large tract of land, Haines & McNeill can assist in that process.

Developer Representation

We regularly represent several of the areas largest and most active real estate developers in all aspects of their activities from land acquisition through the entire process of government approvals and the drafting and negotiating of leases or sales contracts. We frequently represent residential developers in sales to home buyers. Our firm is familiar with the plat approval processes in the area and regularly assists our clients and their engineering firms in the completion of municipal dedication packages, including water and sewer dedications and dedications of roads and drainage areas to municipal authorities or homeowner's associations. We can further assist in the creation and incorporation of homeowner's associations and provide other necessary development documents.  

Section 1031 Exchanges

Our attorneys and staff are experienced and well versed in the utilization of 1031 like-kind exchanges and reverse exchanges, representing clients' interests both from a real estate perspective as well as a tax perspective. Drafting both exchange and closing documents, the firm has handled exchanges involving real property, personal property, construction and improvements, multiple exchanges, simultaneous and deferred exchanges. We can also refer clients to or provide an entity to serve as a qualified intermediary or exchange accommodation title holder. Residential Real Estate

A large part of our real estate practice involves residential property, including review or preparation of residential contracts and leases and the closing of purchase or refinance transactions. In South Carolina, real estate closings are considered the practice of law and must be performed by an attorney. The purchaser or borrower has the right to select this closing attorney. We may represent purchasers or sellers or both parties in a residential transaction, according to our clients' preferences. If you would like a quote on fees for a real estate closing, please call and discuss with us the details of the transaction. Our fees will vary based upon the type and complexity of the closing. We will be happy to go over the expected costs for all aspects of the closing, including title insurance premiums and title abstract fees or to assist you in the preparation and execution of a contract if one has not yet been created. 

For some basic information on legal issues involved in a residential closing, please take a moment to review a brochure provided by the South Carolina Bar that gives a brief overview of many of the issues involved in a residential purchase. (This brochure and the documents referred to below are formatted in Adobe pdf. The latest version of Adobe Reader is available for free download on Adobe's website.) If you are a Seller in a residential real estate transaction, you will need to provide certain disclosures mandated by South Carolina law if you are not otherwise exempt. It may be helpful to you to have this information prepared in advance as you begin the process of selling your home.

Many homeowners  and purchasers have questions regarding owner's and lender's title insurance and whether they should purchase an owner's policy. The American Land Title Association's website contains helpful information regarding title insurance. At closing, we will provide you or your lender title insurance as agents of First American Title Insurance Corporation. If you have any further questions about an owner's policy and what defects it protects you against, please contact us for more information.
